A pre-launch draft, written to describe what kywrd actually does.

Draft — pending legal review

This is a pre-launch draft. It has not been reviewed by a lawyer — including the arbitration clause below — and should not be relied on as a binding agreement or as legal advice until it has been.

1. What kywrd is

kywrd is a subscription tool that tracks keyword rankings and store-listing metadata for apps on the Apple App Store and Google Play, and generates suggested changes to that metadata — titles, subtitles, descriptions, and keyword fields — for you to review. kywrd does not publish anything to either store on your behalf; every change reaches a store only if you copy it there yourself.

2. We do not guarantee outcomes

Ranking data, keyword estimates, and generated recommendations are informational. kywrd does not guarantee any ranking position, search impression, download, install, or revenue outcome, for any keyword, app, or time period. App store search algorithms are controlled by Apple and Google, not by us, and both change without notice. Acting on a kywrd recommendation is your decision, and the result is not something we can promise.

3. Estimates are labeled, and only an estimate

Some figures kywrd shows you are published directly by a store — for example, Apple’s search popularity score — and we label these measured. Others are kywrd’s own model or rule of thumb — for example, Google Play search volume, which Google does not publish at all — and we label these modeled or heuristic. A modeled or heuristic figure is an estimate, not a measurement, and should be treated accordingly.

4. Ownership — your listing, our data

You own the metadata kywrd generates for your app — titles, subtitles, descriptions, keyword sets, and any other text kywrd drafts for you. You are solely responsible for what you actually publish to the App Store or Google Play, including compliance with each store’s guidelines, trademark and content policies, and any claims your listing makes. kywrd validates generated text against each store’s published character limits and field rules before showing it to you, but that check is not a guarantee a store will accept it, and it is not legal, trademark, or compliance advice.

Separately: the rank observations, difficulty scores, and research reports kywrd produces while tracking your app — the underlying data, as distinct from the metadata drafted for your listing — remain kywrd’s. You can use them to run your own app. You may not resell or redistribute them (see Acceptable use, below).

5. Acceptable use

Your subscription covers one organization. You may not:

  • resell, redistribute, or provide third-party access to kywrd’s data or recommendations as a service;
  • use automated tools to bulk-extract data from kywrd outside the product’s own export features; or
  • share a single subscription across multiple organizations or unrelated teams.

6. Not affiliated with Apple or Google

kywrd reads publicly available store listing pages and public or semi-public store APIs to gather the data it shows you. kywrd is not affiliated with, endorsed by, sponsored by, or partnered with Apple Inc. or Google LLC. “App Store,” “Google Play,” and related names are trademarks of their respective owners, used here only to describe what kywrd does.

7. Subscription and billing

kywrd is billed per app tracked, not per seat: $19/app/month, or $190 an app, per year, paid in advance. Adding an app to your account adds it to your bill starting at your next billing cycle unless stated otherwise at checkout.

8. Cancellation and refunds

You may cancel at any time. Cancellation takes effect at the end of the billing period you have already paid for, and you keep access until then. We do not provide refunds for partial subscription periods, including if you cancel partway through a month or year, except where required by law.

9. Suspension and termination

We may suspend or terminate access to kywrd for violation of these terms, non-payment, or use that puts the service, other customers, or our data sources at risk — for example, activity that gets kywrd’s data collection blocked by a store. Where the risk is not immediate, we will try to give notice first.

10. Disclaimer of warranties

kywrd is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that any data — measured, modeled, or heuristic — is accurate or complete.

11. Limitation of liability

To the maximum extent permitted by law, kywrd and its operator are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of or inability to use the service, even if advised of the possibility. Our total liability for any claim relating to kywrd is limited to the amount you paid us in the twelve months before the claim arose.

12. Changes to these terms

We may update these terms as the product changes. If we make a material change, we will notify active customers — by email or an in-product notice — before it takes effect. Continuing to use kywrd after a change takes effect means you accept it.

13. Governing law

These terms are governed by the laws of the laws of the State of New York, without regard to conflict-of-law principles.

14. Arbitration

Any dispute arising from these terms or your use of kywrd will be resolved through binding, individual arbitration under New York law — not in court, and not as a class action. Both sides give up the right to a jury trial and to bring or join a class action against the other.

Arbitration is administered by AAA or JAMS, under their consumer arbitration rules where those apply. Either side can start it by filing a demand with the administrator. On cost: the customer pays the initial filing fee; all remaining arbitration costs are shared equally between the parties.

If your dispute qualifies for small claims court, you can bring it there instead of arbitration.

15. Contact

kywrd is operated by Attayn Group LLC, doing business as Kywrd and Kywrd.app. Questions about these terms: hello@kywrd.app.
